POLICY

Agreement
This agreement is between the Customer and Left Coast Systems Corp. doing business as SuperWebhost.com and you the Customer agrees to periodically consult this website for changes or amendments to this Agreement. While using services provided by SuperWebhost.com, you agree to the following terms and conditions:

Definitions
"You" "Your" "Users" or "Customer" refers to each person or entity who has a service provided by SuperWebhost.
"We" "Us" "Provider" or "SuperWebhost" refers to Left Coast Systems Corp. dba SuperWebhost.com

Services Provided
SuperWebhost.com provides Hosting and Internet related services to clients located around the world and provides access to certain servers for the purpose of connecting information to the global internet. SuperWebhost.com claims no control of the content displayed or transmitted through our network. SuperWebhost.com makes no warranties of any kind for the service provided.

Disk Usage
Every account has 1GB online disk storage available to it for storing actively used files. Web, Email and MySQL usage all count toward your total usage. Additional online disk storage space is available from the control panel. SuperWebhost.com does not permit any sites that link to, provide content or relate to in anyway for the following types of sites: hacking, phreaking, pirated software, warez files, unauthorized copyrighted products, MP3's, viruses, adult material, and any other material that is prohibited under the laws of Canada and the Province of British Columbia.

Your account is to be used by you only. Reselling or hosting friends within your account is not permitted. Adult material of any kind is not permitted on our servers. Material of any kind that is questionable or not suitable for normal commercial purposes is not permitted on any of our servers. Customers may not run IRC bots or clients. So-called "file sharing" programs, including BitTorrent seeders, trackers and torrent files are not allowed.

Bandwidth Usage
We offer 30GB of transfer per month. When a site reaches 25GB within that month we will email a notice letting you know you are getting close to your limit. You can then choose to leave it or order more bandwidth from the control panel. We do not impose hard limits so your site will not be disabled if you go over. If you go over on a consistent basis we will suggest you purchase additional bandwidth.

Unsolicited eMail
SuperWebhost.com does not permit email harassment, forging or unsolicited email messages. Email is to be used for normal business and personal purposes. For those causing a problem, a warning will be issued and if the problem continues account cancellation will be immediate.

High Resource Policy
High Resource sites are sites that use an excessive amount of system resources such as bandwidth, storage or CPU utilization. It is at our sole digression to decide which sites are high resource sites. We have found this policy effects very few people and is in place for protection of all of our customers. We reserve the right to suspend or terminate any hosting account that we feel is jeopardizing our network.

MySQL Usage Policy
The high resource policy applies to the MySQL system. Individual database users have a simultaneous connection limit in place to prevent resource exhaustion. We offer unlimited databases. The total MySQL disk space used is counted towards your total disk usage.

Back Up Policy
We do not offer any backup services, you are fully responsible for maintaining an up to date copy of your website on your own computer.

99.9% Uptime
Our guarantee to you is that our network will be up and functioning 99.9% of the time per month. If your web site is not available for more than 99.9% of the time within a month, we will credit the following month's service.

Credits are issued as follows:
95% to 99.8% 10% of your monthly hosting fee.
90% to 94.9% 20% of your monthly hosting fee.
89.9% or below 50% of your monthly hosting fee.

Services include HTTP (your website), FTP, Virtual Server Manager, Telnet, SSH, SSL, MySQL and SMTP & POP3 (email services). Our monitoring software is the determining factor of the uptime of our service, and not any one client's experience. Please understand we do not have control over the Internet or your ISP, therefore we cannot guarantee that you will be able to access your site due to circumstances beyond our control. Any downtime that occurs during a scheduled maintenance window shall not be counted towards our Uptime Guarantee. Maintenance, if needed is usually performed between the hours of 12:00am and 1:00am and announcements will be posted 24 hours in advance in the Server News and Information Forum. Please request credit within seven business days after you experienced any downtime. Simply send an email to sales@superwebhost.com with your name, domain name, and the dates and times of the unavailability. Credits will be confirmed and usually be applied within sixty days of your request.

Payment
Billing is done by Visa or MasterCard only. Accounts will be billed on a recurring monthly basis starting from the day your account was setup. Left Coast Systems Corp. will appear on your credit card statement. Customers located in the United States are billed in US Dollars. Customers outside of the United States are billed in Canadian dollars. Canadian orders are subject to 7% GST. No bills or invoices will be sent by postal mail or fax. Receipts are emailed by request only. If your card is declined we will notify you by email, please be sure to respond right away to avoid account disruption. If you receive a new card, lost a card or change cards, please save us time and let us know the new numbers via the control panel. Any account deactivated due to non-payment must contact our billing department to reactivate it. We can not guarantee that your account will be activated or that the data will be fully intact for overdue accounts.

Renewals
Your account is renewed automatically under the same term and fee when you signed up. In order to stop us from billing you must cancel your account with us, via the cancel form. Domain names are renewed on a yearly basis depending on how many years you selected. Domain name renewals are not automatic and we must be notified you do wish to renew your domain name. We send email reminders starting 90 days before the renewal date. Please be sure your domain registration information is correct.

Cancellation
Customers may cancel anytime and must do so using our cancel form. We require your name, web site address, user name, password and reason for cancellation. We will then confirm your next billing date and cancel your account on that date and remove you from billing unless a date is specified. We will refund prepaid fees for hosting for the full months remaining less an early cancellation fee of $25. No refund will be sent for any unused portion of a month. Once the site has been deleted, there is no way to retrieve it. We do not provide refunds for registered domain names. We do not provide refund for accounts we terminate. Refunds will be issued to your credit card within 10 business days.

30 Day Guarantee
If you are not satisfied with our web hosting service for any reason and wish to leave, let us know and we will refund your money. It is very important to us to take care of our customers in the beginning, middle and end of our relationship. If you are not satisfied for some reason and wish to stay with us, let us know and we will find out what happened and if it turns out to be something we could have done better we will credit your account with one month. If you received a free domain with our special offer you will be required to pay for it.

Network Maintenance
Maintenance, if needed is usually performed between the hours of 12:00am and 1:00am and announcements will be posted 24 hours in advance in the Server News and Information forum.

Right to Refuse Service
SuperWebhost.com reserves the right to refuse service, suspend or cancel any User for any reason at any time with no notification. Any User found with inappropriate actions or questionable actions will have their account cancelled immediately.

Privacy Practices
We recognize the necessity for data privacy. On a shared network, with other network traffic the potential for exposing confidential information is always a factor. We provide encryption tools for data privacy including OpenPGP, SSL and SSH. In addition, we offer our own brand of SSL certificates. Please read our Privacy Policy is here.

Warranty, Limitation of Liability, Indemnification
SuperWebhost.com may only be used for lawful purposes only. The User warrants that it will not engage in any such activities but not limited to: that constitute or encourage a violation of any applicable law or regulation, including but not limited to the sale of illegal goods or the violation of export control or obscenity laws; that defame, impersonate or invade the privacy of any third party or entity; that infringe the rights of any third party, including but not limited to the intellectual property, business, contractual, or fiduciary rights of others; and, that are in any way connected with the transmission of "junk mail" "Spam" or the unsolicited mass distribution of e-mail, or with any unethical marketing practices.

SuperWebhost.com reserves the right to change fees, plans or add services at any time. SuperWebhost.com claims no responsibility for any damages or loss of service you may suffer whatsoever. You are responsible for keeping backups of your data. You agree not to attempt to gain unauthorized access to any server on the SuperWebhost.com Network. You agree to pay the fee agreed upon signing. You agree to indemnify and hold SuperWebhost.com harmless from any claims that may arise resulting from the use of the SuperWebhost.com Network, which damages you or someone else. "Free" web and Email hosting is not permitted on the SuperWebhost.com network. All terms and conditions within supersede any oral or written agreements. Use of the SuperWebhost.com Network constitutes acceptance of these terms and conditions.
